Dynamic pricing offers: the transitional regime extended to 30 June 2027
On 19 June 2026, the CRE announced the extension of the scheme applicable to suppliers with more than 200,000 customers, pending a ruling by October 2026.
On 19 June 2026, the French Energy Regulatory Commission extended until 30 June 2027 the transitional regime for implementing the obligation to offer a dynamic pricing contract.
This obligation stems from the transposition into French law of the European directive of 5 June 2019 on common rules for the internal electricity market, which requires the largest suppliers to offer at least one dynamic pricing contract.
The arrangements for taking market price variations into account had been defined by the CRE in its ruling of 20 May 2021. Against the backdrop of the wholesale price crisis, a transitional regime relaxing these arrangements was put in place by the ruling of 27 July 2022.
Following a public consultation launched on 22 January 2026, the CRE identified the need to revise these arrangements. As further work remains to be carried out, it will issue a ruling by October 2026.
In the meantime, the transitional widening is maintained: suppliers with more than 200,000 sites may satisfy the obligation through market offers that give consumers a financial incentive, in response to a short-term signal, to curtail or shift their consumption.
